Wellington West BIA Contest Rules

1. All BIA promotions are carried out to publicize and direct customers towards our local member merchants in the Ottawa neighbourhoods of Hintonburg and Wellington Village. Therefore, unless otherwise specified, preference will be given in awarding contest prizes either to: a. residents of the greater Ottawa/Gatineau area; or b. Those who frequent our area and/or intend to visit our area in the near future.  
2. The rules contained herein govern only contests and promotions run directly by the Wellington West BIA (the “BIA”). Contests and promotions run by third parties will be governed by the rules established by that third party and the BIA assumes no responsibility, control or liability for that contest/promotion. This applies to all third parties, no matter their association to the BIA (sponsor, partner, etc.); nor if they are using the BIA’s name and/or likeness; and no matter where the contest is being held.
3. The BIA reserves the right to determine when a contest starts and when it closes to entries. When possible, the BIA will give notice of the approximate duration of a contest when it is announced and/or when it starts.
4. Unless otherwise specified, all contests and promotions are open to all ages. If the winner is under 18, the BIA may require that a permission form be signed by a legal guardian in order to receive the prize.
5. By entering any promo/contest, the winner gives permission to the BIA to use his/her first name and/or social media handle for any future announcements or advertisements of the promo/contest.
6. The BIA promos/contests which are run through social media networks, including Facebook, Twitter and/or Instagram may be advertised only through the specific social media channel(s) being used; the only way to enter the promos/contest is through the specific social media channel(s) being used.
7. Entries into any promo/contest run on social media networks must be publicly visible to be eligible.
8. The entrant into any contest/promo conducted through social media will be only the individual person who submitted the entry from his/her account on that social media platform.
9. The BIA reserves the right to limit the number of entries from an individual person into a contest or promotion.
10. Unless otherwise specified, any “gift certificate” awarded as a promotional prize by the BIA or donated to community partners, is essentially a voucher for a specified dollar amount usable at any merchant within the boundaries of Wellington West BIA. Upon contacting the BIA staff, the winner may select a member merchant, after which BIA staff will either a. arrange to purchase a gift certificate or equivalent store credit in that amount, or b. in the event that this is not possible for whatever reason, to arrange an alternate gift at a different merchant.
11. Prizes must be claimed within a reasonable time period, which shall be either a. before the expiry date specified on the printed prize certificate; or b. six months from the date of award if no date is otherwise specified.  
12. Unless otherwise specified, any gift certificates awarded as prizes will be restricted to members of the BIA. If the prize includes, in whole or in part, a gift certificate to the merchant of the winner’s choice, the BIA reserves the right to restrict the selection of available merchants to members of the BIA.
13. Prize(s) must be accepted as awarded. The Prize(s) may not be sold or transferred and is/are not convertible to cash. The BIA reserves the right to substitute the Prize(s) in whole or in part in the event that all of any component of the Prize is unavailable. Any taxes and other incidental charges associated with a prize(s), if applicable, are the sole responsibility of the winner.
14. Prizes won in any BIA promo/contest have no cash value and must be accepted as presented and may not be returned for cash or exchanged.
15. If for any reason, in the opinion of the BIA, in its sole discretion, the Promo/Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the property conduct of the Contest is corrupted or adversely affected, including but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes, or for any other reason whatsoever, the BIA reserves its right, without need of individual notice, to cancel, terminate, modify, amend, extend or suspend the Contest in whole or in part, including, without limitation, canceling any method of entry, and/or selecting a winner from previously received eligible entries. The BIA reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Contest Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such attempt be made the BIA reserves its right to seek remedies and damages to the fullest extent of the law.  The BIA and/or its agents and advertising and promotional agencies shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest website, where applicable.
